Stellagent Inc. and its affiliates (collectively, "we," "us," or "our") provide an advanced AI-powered e-commerce operations support service called "Presso" (the "Service"). This Privacy Policy explains how we handle personal information collected through the Service.

1. Personal Information We Collect

Depending on the nature of your interactions with us, we may collect the following personal information.

1.1. Information You Provide Directly

Contact Data: Your first and last name, email address, billing and mailing addresses, job title, company name, and phone number.

Profile Data: Username and password you register when setting up an online account for the Service, teams you belong to, and other information you add to your account profile.

Communication Data: Information based on your interactions when you contact us through the Service, social media, or other means.

Transaction Data: Information related to or necessary to complete subscriptions on or through the Service, including subscription type and transaction history.

Marketing Data: Your preferences for receiving marketing communications from us and details of your engagement with them.

Input, Prompts, and User-Generated Content: Messages, questions, files, and other content or information that you input, use as prompts, generate, transmit, or otherwise make available on the Service, as well as related metadata (e.g., when, where, and how content was collected or edited, keywords, location information).

Integrated Service Data: Data retrieved from third-party services such as Shopify, advertising platforms, SEO tools, CRM, and inventory management systems that you connect to the Service through OAuth authentication or similar means. This includes sales data, product information, customer data, advertising performance data, inventory information, and other operational data.

Data Derived from Your Input: When you use certain features of the Service, we may derive certain information from your input to provide those features. We do not use such data for the purpose of identifying specific individuals.

Payment Data: Payment information required to complete transactions is collected and processed directly by our payment processor, such as Stripe. Please refer to Section 4 "Sharing and Disclosure of Personal Information" for details.

Other Data: For data not specifically described here, we use it as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Please do not provide us with sensitive personal information (e.g., social security numbers, financial account numbers, government-issued ID numbers, racial or ethnic origin, political opinions, religious or other beliefs, health information, biometric or genetic information, criminal history) on the Service or otherwise.

1.2. Information We Obtain from Third Parties

We may combine personal information we receive from you with personal information we obtain from other sources, such as:

Public Sources: Public records, social media platforms, and other publicly available sources.

Third-Party AI Providers: Portions of the Service are integrated with third-party AI platforms (such as Claude, ChatGPT, and Gemini; collectively, "Third-Party AI Providers") that help generate outputs (i.e., responses) to your input and prompts. These Third-Party AI Providers may infer information about you as part of their processing and share it with us.

Service Providers: Parties that provide services on our behalf or help operate the Service or our business.

Third-Party Login/Integrated Services: Third-party services such as Google and Apple that you use to log in to or link with your Service account. This data may include your username and other information provided to us based on your account settings on such third-party services.

E-Commerce Platforms and Integrated Services: Shopify, Google Ads, and other e-commerce platforms and operational tools that you connect to the Service through OAuth authentication or similar means. This data includes operational data retrieved from services for which you have authorized integration.

1.3. Information Collected Automatically

We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your interactions with the Service and our communications over time. For example:

Device Data: Operating system type and version, manufacturer and model, browser type, screen resolution, IP address, unique identifiers, language settings, and general location information such as city, state/province, and geographic area.

Online Activity Data: Pages or screens viewed, time spent on a page or screen, websites visited before browsing the Service, navigation paths between pages, access times and duration, whether you opened emails from us, and whether you clicked links in emails.

Communication Interaction Data: Your interactions with emails and other communications from us (e.g., whether you opened or forwarded them). We may collect this data using pixel tags (also called clear GIFs), which may be embedded in our emails.

2. Cookies and Other Tracking Technologies

Some of the automatic collection described above is facilitated by cookies and other technologies. We also use technology provided by Third-Party AI Providers to operate chat and prompt features that you can use to communicate with us and enter data. These technologies may use cookies and software code.

3. How We Use Personal Information

We do not use your personal information to develop, train, or improve our own artificial intelligence or machine learning models. However, Third-Party AI Providers that support certain features of the Service may process your data in accordance with their respective policies and terms of service.

We may use your personal information for the following purposes, or as otherwise explained at the time of collection:

Providing and Operating the Service:

  • To provide the Service.
  • To send your input to Third-Party AI Providers for processing and receive outputs when necessary to fulfill your requests.
  • To retrieve data from third-party services (Shopify, advertising platforms, SEO tools, CRM, inventory management systems, etc.) for which you have authorized integration, and to integrate and analyze such data.
  • To provide workflow automation through Skills functionality.
  • To enable security features of the Service.
  • To set up and maintain your user account on the Service.
  • To communicate with you about the Service, including sending service-related announcements, updates, security alerts, and support and administrative messages.
  • To provide support for the Service and respond to your requests, questions, and feedback.

Personalizing the Service:

  • To understand your needs and interests.
  • To personalize your experience with the Service and our service-related communications.
  • To remember your choices and settings when navigating web pages.

Improving and Analyzing the Service:

  • To analyze how the Service is used by you and to improve the Service and our overall business.
  • To understand user activity on the Service, including most and least viewed pages.
  • To develop new products and services.

Marketing and Advertising:

Direct Marketing: We may send you direct marketing communications and personalize these messages based on your needs and interests. For information on how to opt out, please see Section 6 "Your Rights and Choices."

Legal Compliance and Protection:

  • To comply with applicable laws, lawful requests, and legal processes (such as responding to subpoenas, investigations, and requests from government authorities).

We may use and share this data with third parties for our lawful business purposes, including to analyze and improve the Service and promote our business.

4. Sharing and Disclosure of Personal Information

We may share your personal information with the following parties as described in this Privacy Policy, other applicable notices, or at the time of collection:

Affiliates: Our parent company, subsidiaries, and affiliates.

Service Providers: Third parties that provide services on our behalf or help operate the Service or our business (hosting, IT, customer support, email delivery, marketing, website analytics, etc.).

Third-Party AI Providers: We use Third-Party AI Providers (such as Claude, ChatGPT, and Gemini) to support certain aspects of the Service, including operating chat functionality, processing user input/prompts, data analysis, and recommendations.

E-Commerce Platforms and Integrated Services: Shopify, advertising platforms, and other services for which you have authorized integration with the Service through OAuth authentication or similar means. We send and receive data to and from these services based on your instructions.

Payment Processors: Credit card information used for purchases on the Service is collected and processed directly by our payment processors, such as Stripe.

Third Parties You Designate: We may share your personal information with third parties when we receive instructions from you or with your consent.

Linked Third-Party Services: When you use social media or other third-party services to log in to the Service or link your Service account with such services, we may share your personal information with such third-party services.

Professional Advisors: Professional advisors such as lawyers, auditors, banks, and insurance companies when necessary in the course of providing professional services to us.

Authorities and Other Parties: Law enforcement agencies, government authorities, and private parties when we determine in good faith that it is necessary or appropriate for the "Legal Compliance and Protection" purposes described above.

Business Transferees: We may disclose personal information in connection with actual or prospective business transactions (e.g., investments, financing, public offerings, or sales, transfers, or mergers of all or part of our business, assets, or stock).

Other Users and the Public: By your choice, user-generated content may be made available to other users of the Service and the public. We are not responsible for the use of such information.

We generally retain personal information for as long as necessary to fulfill the purposes for which it was collected, to satisfy legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes. In determining appropriate retention periods, we consider factors such as the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it, and applicable legal requirements.

6. Your Rights and Choices

This section describes rights and choices that apply to all users.

Access or Update Information: If you have registered an account with us, you can review and update certain account information by logging into your account.

Opt Out of Communications: For marketing-related emails, you can opt out by following the opt-out or unsubscribe instructions at the bottom of the email or by contacting us.

Cookies: For information about cookies and other technologies used on the Service and how to control them, please refer to our Cookie Policy.

Blocking Images: Most browsers and devices can be configured to prevent images from loading.

Do Not Track: Some internet browsers may be configured to send "Do Not Track" signals. We currently do not respond to these signals.

Declining to Provide Information: If you do not provide information that we identify as required or necessary, we may not be able to provide certain services.

Linked Third-Party Platforms: If you choose to connect to the Service through a third-party platform, you may be able to limit the information we receive by using the account settings on that platform.

Managing Service Integrations: You can disconnect Shopify, advertising platforms, and other integrated services from the Service settings screen at any time.

Deleting Content or Closing Your Account: You may choose to delete certain content through your account. If you wish to close your account, please contact us.

7. Other Sites and Services

The Service may contain links to websites and other online services operated by third parties. These links do not constitute an endorsement of, or represent that we are affiliated with, any third party. We do not control online services operated by third parties and are not responsible for their actions.

8. Security

We employ technical, organizational, and physical safeguards designed to protect the personal information we collect. However, online transmissions are not completely secure, and we are not responsible for unauthorized circumvention of any privacy or security measures.

9. International Data Transfers

We are headquartered in Japan but may use service providers that operate in other countries. Your personal information may be transferred to the United States or other locations where privacy laws may be less protective than those in your state, province, or country.

10. Children's Privacy

The Service is not intended for use by anyone under the age of 18. If you are under 18, you may not use the Service. If we learn that we have collected personal information from a child under 18, we will delete such information in accordance with applicable legal requirements.

11. Changes to This Privacy Policy

We reserve the right to change this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Service, or by other appropriate means.
